Minnesota’s New Financial Exploitation Injunction: An Overview

During this past legislative session, Minnesota passed a new tool to combat financial exploitation with a Vulnerable Adult (VA) Order For Protection (OFP) for Financial Exploitation. Jill Sauber, an elder law attorney involved in the legislation, will present the overview of this new tool.

Objectives/presentation topic is a general overview of Minn. Stat. Β§ 609.2334 (effective January 1, 2026):

1) Definitions including requirements for victim/vulnerable adult and who can be Petitioner (petition to bring the injunction).

2) Timing of the hearing and filing MAARC report – for mandatory reporters and others.

3) Service requirements.

4) Factors the court will take into consideration before issuing an OFP.

5) Other ways to protect the VA including chapter 45A reporting through Commerce website to delay disbursements, reporting through the FBI (ic3), FTC, or other websites, and making a separate APS/MAARC report.
