Part Two: Taking a Deeper Dive: Understanding Decision-Making Alternatives, Rights, and Resources If Trouble Arrives

This session presumes basic understanding of guardianship and conservatorship processes and considerations for risks and benefits of this court intervention. Viewing Part One is strongly recommended for those who have less experience and understanding of guardianship/conservatorship. This session will highlight decision making alternatives which may alleviate the need for establishing or maintaining a guardianship/conservatorship, such as supported decision making, health care directives, connecting to community and residential services, and financial tools such as powers of attorney and representative payee. We will also take a deeper dive into rights of people subject to guardianship, and what to do when there are concerns about a guardian or whether a guardianship is still necessary.

Objectives: At the conclusion of the presentation, participants will be able to:

  • List at least 5 alternatives to guardianship/conservatorship.
  • Describe rights retained by persons subject to guardianship/conservatorship.
  • Explain resources for addressing guardianship concerns.
